Chapter 8: The Council of Europe: Ensuring the Freedom and Independence of Europe’s Media

This chapter sets out and explains how the Council of Europe seeks to protect and promote freedom of expression and the media, through the development and application of legal and policy instruments. The European Court of Human Rights has held that Member States of the Council of Europe have an obligation to guarantee pluralism in the audiovisual media sector. The Court’s case-law provides some general guidance to States on how to fulfil this obligation, but the political standard-setting texts of the Committee of Ministers (the Council of Europe’s statutory decision-making body) provides more detailed guidance on suitable or recommended measures. This chapter navigates that guidance, paying particular attention to measures to ensure the independence of public service media.
